Key Legislative Changes
Building Safety Act 2022
The Building Safety Act 2022, which received Royal Assent in April 2022, amends the Regulatory Reform (Fire Safety) Order 2005 (FSO). One significant change is that all Responsible Persons are now required to record their completed fire risk assessments and fire safety arrangements in full, regardless of the size or type of business. Previously, this was only mandatory under specific circumstances.
Fire Safety Responsibilities
The amended FSO places several duties on Responsible Persons, including:
- Cooperation and Coordination: In multi-occupied buildings or where the occupier and owner are not the same, there is an increased requirement for cooperation and coordination between Responsible Persons.
- Resident Information: In residential buildings containing two or more domestic premises, residents must be provided with information on fire risks and the safety measures in place to protect them.
- Information Sharing: Departing Responsible Persons must share all relevant fire safety information with incoming Responsible Persons to ensure continuity and safety.
